Why should I use the SHEQAssist helpline?
Get your own SHEQ Legal department for a fraction of the cost of maintaining the same resource in-house and get:
- 24/7 and on-demand access to a SHEQ legal specialist
- Consultants with legal qualifications and industry experience
- Dramatically reduce the Legal compliance learning curve
- Prevent potentially costly incidents of non-compliance
- You may not receive a second chance – Get it right the first time
- Ignorance of the law is no excuse
- Spend less time and money on SHE consultants
- Less Occupational Health & Safety training needed
- Minimise and understand your legal liabilities
- Prevent negligence
As a case in point: In Serfontein and Another v Spoornet 1998 JOL 4220 (SE)the court found that although the second plaintiff was a trespasser, the defendant owed him a duty of care.
The second plaintiff (a boy) claimed for damages after he climbed onto the roof of a railway truck and received a shock from overhead power lines.
The Plaintiffs alleged that the defendant was negligent in several respects:
- Spoornet failed to erect sufficient warning signs,
- failed to switch off the electric power supply when the property was not used;
- failed to exercise proper control over the property and the electricity;
- failed to prevent the incident when, by the exercise of reasonable care, it could have done so.
Needless to say that the court found for the plaintiffs and that Spoornet could easily have prevented the costs, and loss of reputation, had basic Safety, Health and Environmental (SHE) requirements been implemented.

What about our organisation’s extensive insurance portfolio?
- There is a possibility that your insurer might repudiate a claim because of non-compliance with SHE legislation.
- In our opinion, membership to the SHEQAssist helpline should be included in any organisation’s insurance portfolio
- Accessing the SHEQAssist helpline will contribute to fewer incidents and implementing legal requirements will limit the possibility and extent of claims resulting from incidents.
- The SHEQAssist helpline should be considered a Risk Management tool just like your insurance portfolio.
We will appreciate should you have more questions that you would like to be considered for inclusion in this section, please send an email to ben@implex.co.za
